Terms & Conditions
These Terms and Conditions (the "Terms") govern your relationship with White Hat Gaming Limited, as operator of the Casimba online casino services made available to Canadian users through the website casimba-ca.com and its associated review environment Casimba (together, the "Site"). By creating an account, accessing, or using any gambling or related services (the "Services") via the Site, you agree to be bound by these Terms, effective as of 1 January 2026.
Definitions
- Operator means White Hat Gaming Limited, a private limited company registered in Malta (company number C73232), with registered office at 85 St John Street, Valletta, VLT1165, Malta, licensed by the Malta Gaming Authority (MGA/B2C/370/2017) and, for Ontario operations, by iGaming Ontario and the Alcohol and Gaming Commission of Ontario (license OPIG1231668).
- Site means casimba-ca.com, including all pages, the Casimba environment, and any subdomains or redirects used to access the Services, which may include redirection to official Casimba domains such as casimba.com (Rest of Canada) or casimba.ca (Ontario).
- Services means all online gambling, betting, casino, live casino, promotional, and ancillary services made available by the Operator through the Site to eligible users located in Canada.
- User or Player means any natural person who accesses the Site and/or registers an account to use the Services.
- Account means a registered player account created by a User and maintained by the Operator for the purpose of accessing the Services.
- Bet or Wager means any sum of money staked by you on any game, event, or outcome offered through the Services.
- Bonus means any funds, free spins, free bets, or other promotional value credited to your Account by the Operator, including welcome offers, reload bonuses, and free spin packages.
- Real Money Balance means funds you have deposited into your Account and any winnings derived therefrom that are not subject to wagering or other restrictions.
- Bonus Balance means all Bonus funds and any winnings derived from Bonus play that are subject to wagering requirements or other conditions before becoming withdrawable.
- Applicable Laws means all laws, regulations, and rules applicable to the Operator and to you, including the laws of Malta, the laws of Canada and its provinces and territories, and the rules of the Malta Gaming Authority, iGaming Ontario, the Alcohol and Gaming Commission of Ontario (AGCO), and any other relevant authority.
- Rest of Canada (RoC) means all Canadian provinces and territories other than Ontario, where Services are offered under the Operator's MGA license via casimba.com as accessed through casimba-ca.com.
- Ontario means the Province of Ontario, Canada, where regulated operations are conducted via casimba.ca under license OPIG1231668 in collaboration with iGaming Ontario and AGCO.
- KYC (Know Your Customer) means identity, age, source of funds and related verification procedures carried out by the Operator to comply with Applicable Laws, including anti-money laundering (AML) and counter-terrorist financing (CTF) requirements.
- Game Rules means the specific rules, payout tables, and mechanics applicable to each game or product, whether displayed on the Site, within the game client, or on the game provider's information screens.
Account Registration
Eligibility and Legal Age
- Age requirement: To open an Account and use the Services, you must:
- be at least 18 years old; and
- be at or above the legal age for gambling in your province or territory of residence (for example, 18 in Alberta, Manitoba, and Québec; 19 in Ontario and most other provinces/territories).
- Residence: You must be physically located in Canada in a province or territory where online gambling with the Operator is lawful and not restricted. You are responsible for ensuring that your use of the Services does not violate any Applicable Laws.
- One account only: You may register only one Account for personal use. Multiple accounts, shared accounts, and corporate accounts are prohibited.
Registration Process
- Information required: When creating an Account, you must provide accurate and complete information, including your full legal name, date of birth, residential address, email address, and any other details requested on the registration form.
- Email verification: You may be required to verify your email address by clicking a confirmation link sent to you. The Operator may restrict access to the Services until verification is completed.
- Truthfulness: You warrant that all information you provide is true, current, and complete, and you agree to promptly update any information that changes (for example, address or email).
Verification, KYC and AML
- Identity checks: To comply with MGA, iGaming Ontario/AGCO, and Canadian AML/CTF obligations (including those overseen by FINTRAC), the Operator may at any time request documents such as:
- government-issued photo identification (e.g., passport, driver licence),
- proof of address (e.g., utility bill, bank statement), and
- proof of payment method ownership and/or source of funds.
- Timing: Verification may be required during registration, before processing withdrawals, upon significant deposits or winnings, or when triggered by risk and responsible-gambling monitoring.
- Failure to provide documents: If you do not provide satisfactory documentation within a reasonable period, the Operator may suspend or close your Account and, where required by law or regulation, withhold funds pending further investigation.
- Regulatory oversight: The Operator's AML and social responsibility controls are subject to ongoing oversight by regulators, including the MGA, iGaming Ontario/AGCO and the UK Gambling Commission (which has previously issued a public statement in 2021 regarding White Hat Gaming Limited's social responsibility and AML framework). You agree that your play may be monitored and assessed in line with these obligations.
Account Security and Responsible Use
- Credentials: You must keep your username, password, and any security details strictly confidential. You are responsible for all activity on your Account unless it results from the Operator's failure to exercise reasonable care.
- Unauthorized access: If you suspect that your Account has been compromised, you must immediately change your password and contact customer support via the Site. The Operator may temporarily suspend the Account while investigating.
- Responsible gambling: You should only gamble with money you can afford to lose. The Operator provides tools (such as deposit limits, loss limits, reality checks, time-outs and self-exclusion) as required by Applicable Laws and regulator guidelines (including iGaming Ontario and AGCO in Ontario and MGA in RoC). Using these tools does not limit your responsibility to manage your gambling behaviour.
Betting & Gameplay Rules
General Betting Rules
- Placing bets: Bets may only be placed via your Account using the interfaces provided on the Site or within the games. A bet is accepted once it appears in your game or transaction history and has been confirmed by the Operator's systems.
- Currency: For Canadian Users, the primary currency is Canadian dollars (CAD), unless otherwise stated. Any currency conversion, where applicable, will be carried out by the payment provider or the Operator at the prevailing rate, and you are responsible for any associated fees.
- Minimum and maximum stakes: Each game and table may have its own minimum and maximum bet limits. These limits are displayed within the game interface or on the Site and may change from time to time.
- Game rules: All bets are subject to the Game Rules and to additional rules contained in any specific promotion or tournament. In case of conflict between general rules and specific Game Rules, the latter will prevail for that game.
Acceptance, Cancellation and Errors
- Finality of bets: Once a bet has been placed and accepted by the Operator's systems, it cannot normally be cancelled or modified by you.
- Operator cancellation: The Operator may cancel or void any bet (in whole or in part) if:
- a clear error or misconfiguration occurred (for example, incorrect odds, mis-stated pay table, or obvious software malfunction);
- the bet was placed after an event's outcome was already known or should reasonably have been known;
- you or a third party acting with you has breached these Terms, the Game Rules, or any Applicable Law.
- Malfunctions: In the event of a technical malfunction or interruption (including system, hardware, software, or network failures), the Operator will act reasonably and in accordance with Applicable Laws and testing standards (including eCOGRA certifications) to restore the game state or void affected bets. Generally, "malfunction voids all pays and plays" as indicated in many Game Rules.
Live Casino, Chats and Player Conduct
- Respectful behaviour: When using live casino tables, chat features, or any interactive component of the Services, you must behave respectfully. The following are strictly prohibited:
- insults, harassment, bullying, threats, or hate speech;
- obscene, defamatory, or discriminatory content;
- advertising or promoting other products, services, or websites;
- sharing personal contact details or encouraging off-platform communications.
- Fraud and collusion: You must not engage in any form of cheating, collusion, use of bots or automated tools, match-fixing, advantage play contrary to Game Rules, or exploitation of software bugs. The Operator may suspend or close Accounts and void bets and winnings where reasonable evidence of such conduct exists.
- Fair gaming: Game outcomes are determined by certified random number generators (RNGs) or by real-world outcomes in live games, independently tested by entities including eCOGRA and other approved laboratories. The Operator will publish return-to-player (RTP) information at or via https://casimba.com/en-ca/rtp or the equivalent Canadian-facing RTP pages accessible through casimba-ca.com.
Bonus Terms
Bonus Activation and Wagering Requirements
- Offer-specific rules: All Bonuses and promotions are subject to these general Bonus Terms and to the specific terms of each offer as published on the Site and, for Canadian players, at https://casimba.com/en-ca/promoterms (or any updated Canadian-facing promotional terms linked via casimba-ca.com). In case of conflict, the specific offer terms prevail.
- Activation: Bonuses may require:
- an opt-in action (for example, checking a box or entering a bonus code);
- a minimum qualifying deposit; and/or
- acceptance of specific promotional conditions.
- Wagering: Before Bonus funds (and any associated winnings) may be withdrawn, you must meet the wagering requirements specified in the relevant offer (for example, wagering the Bonus and/or deposit a defined number of times). Wagering contribution may differ by game type; some games may contribute 0%.
- Time limits: Bonuses and free spins are subject to expiry timeframes stated in the specific offer (for example, a requirement to complete wagering within a set number of days from activation). Unused or un-wagered Bonuses may be removed upon expiry.
Use of Bonuses and Prohibited Practices
- Game restrictions: Certain games or categories (e.g., some table games, high-variance slots, or jackpot games) may be excluded or contribute at a reduced rate toward wagering. The list of restricted or partially contributing games is provided in the promotional terms and may be updated periodically.
- Bonus abuse: The following, among others, may be treated as Bonus abuse:
- placing bets with very low risk or minimal house edge solely to clear wagering requirements;
- hedging bets (for example, betting on both sides of an outcome);
- using multiple Accounts, VPNs, or identity fraud to claim offers more than once;
- transferring funds between Accounts or acting in concert with others to exploit promotions.
- Real money first: Unless otherwise stated, stakes are normally deducted from your Real Money Balance before your Bonus Balance. Once the Bonus Balance is active, bets may be considered Bonus play for the purposes of wagering requirements.
- Combining promotions: Promotions cannot usually be combined unless expressly permitted. You may not receive overlapping welcome offers, reload bonuses, or other promotions in relation to the same deposit or gameplay session except where clearly stated in the promotional terms.
Payments & Withdrawals
Deposits
- Payment methods: The Operator makes available one or more deposit methods suitable for Canadian Users, which may include credit and debit cards, online banking, e-wallets, and other regulated payment services. Availability may vary by province/territory, financial institution, and Applicable Laws, and the list of available methods is presented in the Site's cashier.
- Funding your Account: You may only deposit funds that originate from lawful sources and belong to you. Using third-party payment methods without the owner's authorization is strictly prohibited and may lead to Account closure.
- Deposit limits: Minimum and maximum deposit amounts apply and are displayed in the cashier for each method. The Operator may also impose individual limits based on responsible-gambling assessments or AML/CTF obligations.
- Fees: The Operator aims not to charge deposit fees; however, certain payment providers or banks may apply their own charges or currency conversion fees, for which you are responsible.
Withdrawals
- Eligibility: You may request withdrawal of your Real Money Balance, subject to:
- completion of KYC/AML checks;
- satisfaction of any applicable wagering requirements and bonus conditions; and
- absence of suspected fraud, chargebacks, or other prohibited activity.
- Methods and limits: Withdrawals are, where possible, processed via the same method used for deposit or another method chosen by the Operator in line with AML/CTF rules. Minimum and maximum withdrawal limits apply per transaction and/or per time period, as shown in the cashier.
- Processing times: The Operator endeavours to review and approve withdrawal requests promptly and, once approved, to process payments within commercially reasonable timeframes (for example, within a few business days, depending on method and verification requirements). Actual receipt times may vary due to third-party processors and banks.
- Fees and reversals: The Operator may charge reasonable fees for processing withdrawals or account closures where permitted by Applicable Laws and disclosed in the cashier or these Terms. Withdrawals may not be reversed once they have been processed; you may, however, cancel pending requests where the Site explicitly offers such an option.
Refunds and Chargebacks
- No refund for settled bets: Bets that have been settled or resolved cannot be cancelled or refunded, except where the Operator voids them in accordance with these Terms.
- Bonus-related refunds: If you request removal of an active Bonus, or if a Bonus is cancelled due to expiry or breach of Bonus Terms, the Bonus and any associated winnings may be removed from your Account. Your Real Money Balance is not normally affected, except where funds are linked to fraud or unlawful activity.
- Chargebacks: If a chargeback or payment dispute is initiated with your payment provider, the Operator may suspend or close your Account, reverse relevant winnings, and recover outstanding amounts owed. The Operator may share information with payment providers, regulators, and law enforcement where necessary.
Limitation of Liability
Operator's Obligations and Fairness
- Provision of Services: The Operator will provide the Services with reasonable care and skill, in accordance with Applicable Laws and the relevant licenses issued by the Malta Gaming Authority, iGaming Ontario/AGCO (for Ontario), and other regulators as applicable.
- Game integrity: The Operator uses certified software and random number generators (RNGs) tested by independent bodies, including eCOGRA and other approved laboratories, to ensure fairness. RTP information is made available via the Site and through Canadian-facing RTP pages such as https://casimba.com/en-ca/rtp.
- Information accuracy: The Operator takes reasonable steps to ensure that information about odds, rules, bonuses, and promotions is accurate; however, typographical errors or obvious mistakes may occur, and the Operator reserves the right to correct such errors and adjust or void affected bets and Bonuses.
Exclusions and Limitations
- Technical issues: To the fullest extent permitted by Applicable Laws, the Operator is not liable for:
- interruptions, delays, or failures caused by internet connectivity, telecommunications, or your hardware/software;
- incompatibility of the Site with your device or configuration;
- loss or corruption of data or content resulting from events beyond the Operator's reasonable control.
- Indirect losses: The Operator is not liable for any indirect, incidental, special, or consequential damages, including loss of profits, business, or data, even if foreseeable, except where such exclusion is prohibited by Canadian consumer protection laws.
- Liability cap: Subject to non-excludable rights under Applicable Laws, the Operator's maximum aggregate liability to you arising out of or in connection with any single bet, game, or incident will not exceed the greater of:
- the amount you staked on the relevant bet or game; or
- the amount of your net winnings from the relevant bet or game.
- No exclusion for serious misconduct: Nothing in these Terms limits or excludes liability for fraud, fraudulent misrepresentation, gross negligence, or any other liability that cannot be limited or excluded under the laws applicable to you.
Intellectual Property Rights
- Ownership: All content on the Site - including text, graphics, logos, trademarks, trade names (including those associated with Casimba as accessed via casimba-ca.com), audio, video, game software, and underlying code - is owned by the Operator, its group companies, licensors, or content providers and is protected by copyright, trademark, and other intellectual property laws.
- Limited licence: You are granted a non-exclusive, non-transferable, revocable licence to access and use the Site and Services on your own device solely for personal entertainment and non-commercial purposes, subject to these Terms.
- Restrictions: You must not, without prior written consent of the Operator:
- copy, reproduce, modify, distribute, display, or publish any part of the Site or its content, except as expressly permitted;
- reverse engineer, decompile, disassemble, or attempt to extract source code from any game client or software;
- use any automated tool or scraper to access or interact with the Site.
- Third-party rights: Games and software provided by third-party suppliers remain the property of those suppliers. Your use of such content is governed by these Terms and any additional terms communicated within the game or on the Site.
Privacy & Data Protection
- Privacy Policy: The Operator collects, uses, and protects your personal information in accordance with its Privacy Policy, as made available on the Site and any Canadian-facing privacy pages accessible via casimba-ca.com and casimba.com. The Privacy Policy forms an integral part of these Terms.
- Compliance: Personal data is processed in accordance with Applicable Laws, including relevant data protection and privacy legislation. The Operator maintains an information security management system certified to ISO 27001 standards, reflecting internationally recognized best practices for protecting player data.
- Purpose of processing: Your data may be used for purposes including account administration, provision of Services, age and identity verification, AML/CTF compliance, responsible-gambling monitoring, transaction processing, and regulatory reporting (for example, to the MGA, iGaming Ontario, AGCO, and FINTRAC where applicable).
- Data sharing: The Operator may share your data with group entities, payment providers, game suppliers, regulators, and independent dispute resolution bodies such as eCOGRA, on a need-to-know basis and subject to appropriate safeguards.
Changes to Terms
- Right to amend: The Operator may modify these Terms from time to time to reflect changes in the Services, Applicable Laws, regulatory requirements, or business practices. Updated Terms will be published on the Site with a revised "Effective date".
- Notice of changes: Where required by law or regulation, or where changes are material, the Operator will take reasonable steps to notify you of the changes, which may include:
- email notification to the address registered on your Account;
- a prominent banner or pop-up on the Site; and/or
- a prompt requiring you to accept the revised Terms before continuing to use the Services.
- Acceptance: By continuing to use the Site or Services after the updated Terms take effect, you are deemed to have accepted them. If you do not agree to the changes, you must stop using the Services and may request closure of your Account and withdrawal of your eligible Real Money Balance.
Termination & Suspension
Operator-Initiated Suspension or Closure
- Grounds: The Operator may suspend or close your Account, restrict access to some or all Services, or withhold funds where it reasonably believes that:
- you have breached these Terms, Bonus Terms, or Game Rules;
- you have provided false, misleading, or incomplete information;
- you are involved in or linked to fraud, money laundering, terrorist financing, or other unlawful activity;
- you have engaged in chargebacks or payment disputes without valid basis;
- you have self-excluded or requested a cooling-off period on any site operated by White Hat Gaming Limited or through a provincial self-exclusion scheme; or
- regulatory authorities (including MGA, iGaming Ontario, or AGCO) have directed or recommended such action.
- Consequences: During suspension, you may be unable to deposit, place bets, or request withdrawals. The Operator may conduct further checks and request additional documents. If closure is confirmed, any remaining Real Money Balance not linked to unlawful or prohibited activity will be returned to you, subject to Applicable Laws.
- Confiscation: Where required or permitted by law or regulation, and in cases of serious breach (including fraud or bonus abuse), the Operator may confiscate Bonuses, winnings, and in some instances stakes, and may report matters to regulators, payment providers, or law enforcement.
Player-Initiated Closure and Self-Exclusion
- Voluntary closure: You may request closure of your Account at any time via the Site or by contacting customer support. After settling any outstanding bets and completing checks, the Operator will return your eligible Real Money Balance, subject to AML/CTF and responsible-gambling requirements.
- Self-exclusion and limits: If you wish to restrict or stop gambling, you may use the self-exclusion and responsible-gambling tools provided on the Site or via provincial schemes (for example, in Ontario through iGaming Ontario/AGCO frameworks). Self-exclusion will normally apply across other White Hat-operated brands where technically and legally feasible.
- Record retention: Even after closure or exclusion, the Operator may retain your data for periods required by Applicable Laws (for example, AML/CTF retention requirements commonly extending for several years and into 2026 and beyond) for regulatory and compliance purposes.
Governing Law & Jurisdiction
Applicable Law
- Rest of Canada (RoC): For Users accessing the Services from Canada outside Ontario via casimba-ca.com and the associated casimba.com platform under MGA license MGA/B2C/370/2017, these Terms are governed by the laws of Malta, without prejudice to any mandatory consumer protection laws of your Canadian province or territory of residence.
- Ontario: Services provided to Users physically located in Ontario are conducted via casimba.ca under license OPIG1231668 in collaboration with iGaming Ontario and AGCO. In such cases, Ontario's laws and the specific Ontario terms and policies published on casimba.ca will prevail. These Terms are intended primarily for RoC Users and should be read together with any Ontario-specific documentation where relevant.
- Mandatory rights: Nothing in these Terms affects any non-excludable rights you may have under the laws of Canada or its provinces/territories.
Dispute Resolution
- Internal complaints: If you have a complaint, you should first contact customer support via the Site, providing full details of your concern. The Operator will acknowledge and investigate your complaint and aim to respond within a reasonable time.
- Alternative Dispute Resolution (ADR): If you are not satisfied with the Operator's final response, and where ADR is available for your jurisdiction and product, you may escalate the dispute to eCOGRA or another approved ADR entity as indicated in the complaints information on the Site and on https://ecogra.org. ADR procedures are independent and free to you in most cases.
- Court jurisdiction: Subject to ADR processes and any mandatory provisions of Canadian law granting you the right to bring claims in local courts, any dispute arising out of or relating to these Terms or the Services for RoC Users shall be subject to the exclusive jurisdiction of the courts of Malta. For Ontario Users, disputes may also fall under the dispute mechanisms and oversight of iGaming Ontario and AGCO as set out in the Ontario-facing documentation.
